Cop's wife accused of murder Police sources contend the wife of a police officer from the District arranged for him to be killed at their Upper Marlboro house and even helped detectives set up the man who did the shooting. Nicolle Therese Baxter, 31, remained jailed without bond Monday for her alleged role in the death of husband Garret Baxter, 34. According to police, Nicolle Baxter hired 31 year old Hayes Capers of Oxon Hill to do the shooting. Garret Baxter was found shot in the garage of his Stan Fey Drive home Sept. 20 by Nicolle Baxter and a friend. Deputy State's Attorney Robert Dean said Monday that Nicolle Baxter had taken out a $1 million insurance policy on her husband, who was on leave from the Metropolitan Police Department at the time of his death. Dean did not confirm reports that Capers was promised a $200,000 pay out for allegedly being the trigger man. But Dean did say that Nicolle Baxter planned to use the insurance money to pay Capers. "Part of the payment was going to come from the insurance proceeds," Dean said. Nicolle Baxter allegedly confessed to arranging the murder during a police interview Oct. 31. Capers was arrested the next day. Attorney Bruce Johnson, who represents Nicolle Baxter, said his client denies doing anything wrong. Johnson dismissed reports that Baxter confessed and said his prior years as a county prosecutor has made him suspicious of supposed confessions. "In my experience, especially in Prince George's County, police officers routinely extract statements," Johnson said. "By no means is this a cut and dry case." Johnson also said that Nicole Baxter might have been the subject of misplaced police scrutiny, because she had formerly worked as an exotic dancer in the District. "That is an issue that has been raised," Johnson said. "I know that the police knew that about her background." A source on the department familiar with the case, however, said investigators recorded Nicolle Baxter's statement on videotape and audiotape. Baxter even helped detectives capture Capers, the source said, by calling Capers and telling him to pick up his cash Friday at a restaurant in Largo. When officers surrounded Capers, the source said, Capers rammed a police van during a failed attempt to elude police. Another source close to the investigation said that Nicolle Baxter was interviewed numerous times before she provided a statement to police Oct. 31. Detectives presented her with specific evidence during that session, the source said. The source declined to reveal details about the interview. Court records and police sources said Nicolle and Garret Baxter struggled with financial problems shortly before the killing. Garret Baxter finalized divorce proceedings with his previous wife Sept. 9, court documents state, and was ordered to pay a lump fee of $13,500 and monthly child support of $1,481. Nicolle Baxter was charged with writing a bad check last November, when she allegedly bounced a check for $7,162. The check was intended to pay for furniture for her Upper Malrboro home, according to a police report, but the charges against her were dropped. According to a police source, Nicolle Baxter also pawned about $20,000 worth of jewelry shortly before her husband's murder. Court documents stated that Hayes Capers was awaiting a Dec. 10 trial for allegedly stealing video disks from a store in Fort Washington when he was arrested Friday. Johnson said that his client's parents are not from the Prince George's County area and that they are very surprised and upset by her arrest.
